The voyage of the La Madonna della Concettione

Departing Livorno sometime after 09-01-1668

Voyage

General Information
General description of the voyage
Wool and other merchandise from Tripoli to Livorno. Sequestration, capture, sequestration again.
Litigation
Those who gave the sea loan (and are thus liable for the maritime risk in this case) object and make a counter claim asking for the restitution of the sea loan.  They argue 1. That such expenses are not chargeable to those who have assumed the maritime risk 2. That the expenses are fabricated, as is the quality and quantity of the merchandise described and that 3. It cannot be true that merchandise was stolen from the master, since his affidavit (which does not appear in the file) makes no mention of that. This objection was obviously overruled in the sentence which followed three days after the production of this document.  See associated case ASP-CM-AC-319-8
Extra information from the source
Although the expenses put into the Avaria reached 8009 pieces of eight, it seems that only 7020 pieces were charged to those who had given cambio marittimo. At the end of the calcolo it says 'Tolti a Cambio in Livorno dà diversi con obligo del padrone Ardissone e di Gio. Tomm. Secchino in tutto - - p.e 7020'. Note also that, even with this reduced sum, the average is 'overloaded', that is that the value of the passive mass does not cover the expenses being claimed. There is no consolato in this case, only a testimoniale e domanda.
