40 moggi = 80 rubbi (very approx. – Captain said 'about 40 moggi', a sailor said 'about 80 rubbi' in his witness statement)
Objections
The merchants provided exceptions and argued that the captain should be liable to pay for the damages as per the freight contract. It was claimed that:
 
    1. >The captain is not able to ask such things and place them in judgment
    2. That the jettison is not true and even if it was it was not carried out because of necessity generated by a fortuna di mare, and that it does not follow the necessary steps laid out in the Consolat de Mar di Barcellona
That the things carried out by the captain are not true and are not lawful
