Litigation
The receiver of the grain (or one of the two to whom it was destined) happened to be in Livorno at the time and put up a spirited defense. He, or his lawyer, submitted a long interrogation of 35 questions, most of which simply repeated information already found in the consolato. All three witnesses were examined on the basis of these questions. Though there is some mildly interesting further information provided (for instance, that they suspected the two square-rigged vessels of being corsairs because they were tacking) there is little disagreement or incriminating evidence provided. The defendant tried to make something of the fact that the crew obviously gave themselves a little holiday at home when they stopped ‘for the weather’ in their home town of Gaeta, but this didn’t come to anything. The defendant also insisted on a second inspection of the ship, which concluded that the hull damage could not have been the result of having been stuck on the shoal. Thanks to this intervention, the hull damage does not make it into the average. The captain was ordered to ready his ship to complete the journey, though since the first report concludes that this could be done in about half an hour, it was not a big imposition. In all other respects the captain was awarded what he asked for – GA on the lost items and the payment of his freight.
